NY commuters face "severe" cuts if court ruling upheld: MTA

(Reuters) - New York City residents and commuters would face devastating service cuts and fare hikes if a court decision overturning the payroll mobility tax - a major revenue source - is upheld, the head of the Metropolitan Transportation Authority said on Thursday.

Chairman Joseph Lhota said the MTA, which operates the nation's largest mass transit system, stands to lose $1.8 billion of revenue a year. The authority's budget for 2012 is $13 billion.

A New York state judge on Wednesday ruled the tax paid by employers in the downstate region the MTA serves was unconstitutional because it does not apply to the entire state.

If the ruling is affirmed, "The MTA would be forced to balance its books with devastatingly severe service cuts and ever-increasing fare hikes," Lhota said at a news conference in Manhattan's Grand Central Terminal.

The MTA runs New York City's buses, subways, and commuter railroads, which carry 8.5 million people a day. It also operates some major bridges and tunnels.

The lawsuit was brought by Nassau County Executive Edward Mangano, a Republican, whose county, which lies on the western half of Long Island, is located within the taxing district.

Mangano said Nassau had paid nearly $10 million in MTA payroll taxes since the law was enacted, adding: "The MTA must become more efficient before asking for more taxpayer dollars."

Lhota said the MTA is putting its fiscal house in order, cutting $700 million of costs on an annualized basis this year.

Employers located in New York City and the seven downstate counties served by the MTA pay the payroll mobility tax, which can be as much as 34 cents for every $100 of salary.

In a financial plan presented in July, the MTA said it expected to end both 2012 and 2013 with a $46 million cash surplus, but slip into deficits after that.

The MTA has appealed directly to the state's top court, which will speed the process. Lhota said he was confident the MTA would win on appeal.

Four other lawsuits that made the same constitutional arguments as the lawsuit filed by Nassau were rejected by a state court in Albany in 2011 and 2012, MTA officials said.

Lhota declined to estimate any possible service cuts or fare increases. The MTA's $93 million of service cuts in 2010, which eliminated over 30 bus routes and two subway lines, was known as the "Doomsday" plan. The reductions have been partly rolled back.

The state enacted the payroll tax to help fund the transportation authority in 2009, after the recession had withered some of the real estate tax revenue it relies on.

UK newspapers steer clear of naked Harry photos

LONDON (AP) ? The prince has no clothes ? but most British newspapers aren't running the pictures.

The country's scandal-loving tabloids devoted many pages Thursday to the story of Prince Harry's naked romp in a Las Vegas hotel suite.

While all initially heeded a warning from royal officials that printing the images would infringe on the prince's privacy, The Sun tabloid said late Thursday it would publish the images in Friday's edition ? making it the first British paper to put a naked Harry on display.

The pictures will run with the headline "Heir it is!"

The Sun, Britain's bestselling daily paper, had creatively avoided splashing a naked Harry on its Thursday front page by getting a staff member named Harry and a 21-year-old female intern to recreate the naked pose under the headline "Harry grabs the crown jewels."

The Rupert Murdoch-owned tabloid said it had decided to run the images because the issue has become about freedom of the press.

"We've thought long and hard about this," managing editor David Dinsmore said, adding that the paper works closely with the royal family and takes heed of their wishes.

Dinsmore said the decision isn't because the paper is against Harry "letting his hair down."

"This is about the ludicrous situation where a picture can be seen by hundreds of millions of people around the world on the Internet, but can't be seen in the nation's favorite paper."

Ireland's Evening Herald ran the stark-naked prince on its front page Thursday, but the British newspapers had made do with pictures of holiday Harry in bathing trunks and fedora hat.

Bob Satchwell, head of industry group the Society of Editors, said papers were merely complying with editors' voluntary Code of Practice, which declares "it is unacceptable to photograph individuals in private places without their consent."

But other media-watchers said a scandal that erupted a year ago over phone-hacking and other tabloid wrongdoing had tamed Britain's once-rambunctious press.

Newspapers were exposed to a trial of public opinion as Judge Brian Leveson's media ethics inquiry heard from celebrities, politicians and crime victims who said their lives had been turned upside down by press intrusion.

The scandal has killed one tabloid, the News of the World ? shut down by owner Rupert Murdoch after revelations about its illegal eavesdropping ? and tarnished the entire British media.

With the inquiry considering whether to impose stricter limits on press freedom, many feel the tabloids are staying away from kiss-and-tells and celebrity scoops that they once would have relished.

Neil Wallis, a former News of the World executive editor, said fallout from the hacking scandal had left newspapers "terrified of their own shadow."

"In this post-Leveson era ... they daren't do things that most of the country, if they saw it in the newspaper, would think 'that's a bit of a laugh,'" Wallis told the BBC.

While newspapers including The Sun and the Daily Mirror proclaimed that the naked photos had been "banned," that is not strictly true.

Several media organizations around the world ran the two naked photos of the prince, which are being sold, according to British media reports, for about 10,000 pounds ($16,000).

British outlets refrained, after receiving a warning Wednesday from palace officials.

Prince Harry's office confirmed it had contacted the Press Complaints Commission, an industry watchdog, which in turn advised newspapers not to publish the pictures.

Any paper that ran them risks being chastised by the commission, which can demand a newspaper publish an apology, but has no power to issue fines.

They could also potentially be open to an invasion-of-privacy lawsuit from the prince.

A letter to the watchdog from royal law firm Harbottle and Lewis warned that royal officials "entirely reserve their rights as to any future steps that they may take should publication take place."

Once, editors might have risked it, arguing that publishing the images was in the public interest because Harry is a public ? and publicly funded ? figure.

Satchwell acknowledged there was a risk Leveson's inquiry could chill press freedom. But he said newspapers were simply behaving responsibly over Harry.

"Of course freedom of the press is vitally, vitally important," he said. "But just because you can publish something doesn't mean that you should."

New non-toxic disinfectant could tackle hospital infections

ScienceDaily (Aug. 6, 2012) ? A new disinfectant, Akwaton, that works at extremely low concentrations could be used in healthcare settings to help control persistent hospital-acquired infections such as Clostridium difficile. The study is reported online in the Journal of Medical Microbiology.

Researchers from the Universit? de Saint-Boniface in Winnipeg, Canada tested the new compound, Akwaton, against bacterial spores that attach to surfaces and are difficult to destroy. Previous work by the group has shown Akwaton is also effective at low concentrations against strains of Meticillin-resistant Staphylococcus aureus and Escherichia coli.

Spore-forming bacteria include C. difficile -- a common bacterium found in healthcare settings whose spores can survive on surfaces for long periods of time. Spores are heat-tolerant and can survive a number of years in a dehydrated state before they are reactivated. Most chemical disinfectants control or prevent spore growth rather than irreversibly destroying them.

The present study showed that Akwaton was able to destroy Bacillus subtilis bacterial spores, suspended in water and attached to stainless steel or glass surfaces, at concentrations well below 1% after just 90 seconds' treatment. It was equally as effective at more dilute concentrations (below 0.1%) if left to act for longer periods.

Lead researcher Dr Mathias Oul?, explained the advantages over other chemical compounds currently used against bacterial spores. "Most disinfectants have to be applied at much higher concentrations -- typically between 4-10% -- to properly get rid of bacterial spores. Unfortunately such high levels of these compounds may also be harmful to humans and other animals. Akwaton is non-corrosive, non-irritable, odourless and is effective at very low concentrations," he said.

"Bacterial spores demonstrate a remarkable resistance to physical and chemical agents as well as ordinary antiseptics. On top of this micro-organisms are becoming increasingly resistant to disinfectants as well as antibiotics.. Our latest study shows Akwaton is effective at destroying these spores as well as bacteria that are known problems in healthcare environments"

Akwaton is fast-acting and non-toxic for humans at low concentrations. Other studies have shown that the compound is also environmentally safe. "All these properties make it an ideal disinfectant for hospitals and laboratories. It may also have great value in the food industry to tackle spore-forming food pathogens such as Bacillus cereus and Clostridium perfringens," explained Dr Oul?.
